VC Bird International Wi-Fi Terms of Use

1. General

The Wi-Fi network is provided by APUA Telecoms, a division of the Antigua Public Utilities Authority incorporated under the Public Utilities Act 1973.

2. Access to the network

The terms must be accepted in order to access the Wi-Fi network in the VC Bird International Airport. The Wi-Fi network is free of charge for the first 15 minutes for persons in the VC Bird International Airport. Thereafter, a user may choose to sign up for one of the paid data plans to continue use of this service. Any other use will result in the blocking of the Wi-Fi access, e.g. if lessees, shops or airline companies use the Wi-Fi network they will be blocked.

3. Provision of service

APUA Telecoms will use reasonable efforts to provide access to the wireless hotspots. We do not guarantee that wireless access will be available to you at all locations all of the time or that the access will be at any particular bandwidth rate. Accordingly, we are not responsible to you if you cannot access wireless networks and hotspots, or if access is temporary or available bandwidth is lower than expected.

4. Liability for the network

APUA Telecoms strives towards keeping the information about the network complete, correct and updated. Any errors will be corrected as far as possible. APUA Telecoms cannot be held liable for the lack of access to the Wi-Fi network, and the user cannot demand any kind of financial compensation for this. Although APUA Telecoms has taken all commercially reasonable steps to provide a secure system, within limitations imposed by network and computer infrastructure, APUA Telecoms does not guarantee that communication over their network shall be secure from monitoring or tampering, nor that information stored on any computer connected to the network shall be secure from monitoring or tampering. THE USER ACKNOWLEDGES THE RISKS ASSOCIATED WITH PUBLIC ACCESS TO THE INTERNET AND HEREBY RELEASES APUA TELECOMS FROM ANY LIABILITY FOR UNAUTHORIZED THIRD PARTY SECURITY BREACHES OR THE RESULTS THEREOF. APUA Telecoms liability under any provision of this Agreement shall be limited to the amount actually paid by you for the service. THIS SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OR CONDITION OF ANY KIND, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABLE QUALITY AND FITNESS FOR A PARTICULAR PURPOSE. APUA TELECOMS DOES NOT WARRANT THAT THIS SERVICE WILL MEET YOUR REQUIREMENTS OR THAT THEIR OPERATION WILL BE ERROR-FREE. IN NO EVENT SHALL APUA TELECOMS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES EVEN IF ADVISED OF THE POSSIBILITY THEREOF, INCLUDING ANY DAMAGES WHATSOEVER RESULTING FROM LOSS OF USE, DATA OR PROFITS, WHETHER IN AN ACTION OF CONTRACT, NEGLIGENCE OR OTHER TORTIOUS ACTION, ARISING OUT OF OR IN CONNECTION WITH THE USE OR PERFORMANCE OF THIS SERVICE.

5. Use of the network

As a user you are obliged to not upload, download, transfer or access material with illegal, discriminating, indecent, pornographic, insulting or hateful content or content that violates other's rights. It is not permitted to use the Wi-Fi network in connection with criminal or civil law violations or acts, administrative regulation or other public rules, including theft or infringement of copyrights, trademarks, trade secrets or other kinds of intellectual rights; fraud; forgery; theft and abuse of financial means, credit cards or personal information; and threats of physical damage or harassment. APUA Telecoms can expel users acting against the terms herein from gaining access to the Wi-Fi network. Moreover, at their discretion APUA Telecoms reserves the right to expel users from gaining access to the Wi-Fi network, if APUA Telecoms finds it necessary to protect its interests.

6. Creation of profile on the Wi-Fi network

You must provide a range of information in connection with log-on to the Wi-Fi network, including email address, credit card or PayPal account numbers etc. APUA Telecoms has the option to save information about your device (notebook, mobile/smartphone) the first time you get access to the Wi-Fi network, so that you subsequently are automatically logged on the Wi-Fi network. If you use a new device you will be asked to log on again.

7. Purchasing and refund policy

When connecting to our Wi-Fi service, you will be redirected to our merchant vendor portal (a third party service) where you will be provided further instructions for billing purposes. All purchases are final, refunds will not be provided. Information required for billing purposes are as per the policies of our third party billing providers. You are advised to read the terms and conditions of the third party provider and to proceed with your purchase only if you agree to same. However, please note that APUA Telecoms will not be responsible for any use of your personal information you provide to this third-party or any other that you may access by way of this service. Please review the privacy policy of all third-party applications or websites that you use.

8. APUA Telecoms Privacy Policy

APUA Telecoms collects certain information that is necessary to fully deliver service to you. As a customer, you will be asked to provide information such as your name, address, phone number, e-mail address and billing information. We may use this Information for editorial and feedback purposes, marketing and promotional purposes, for statistical analysis, product development and in connection with our partners, publishers, advertisers or connected sites. Except as described in this Section, APUA Telecoms will not divulge any of your personal information, contact, financial, bill history, or geographic location -- to any other organization unless (1) you give us explicit and specific, prior permission (2) the disclosure is required by law or by legal process authorized by a court of competent jurisdiction, (3) we suspect fraud by a customer, in which case we may investigate and report any evidence, including personal information, to law enforcement officials and to the courts in the course of seeking remedies at law and equity, and/or (4) you make an inquiry, request or complaint that requires follow-up and we share your information with others to satisfy your inquiry.

9. Amendment of the terms

These terms may be amended by APUA Telecoms without notice.

10. Choice of law and jurisdiction

These terms are subject to the laws of Antigua and Barbuda.
